Abstract
The division of inheritance according to Surah An-Nisa verse 11, namely the male share is twice as much as the female share and the Compilation of Islamic Law is explained in book II regarding inheritance law starting from Article 171 to Article 186. However, in several areas in Indonesia, most of the people are distribution of inheritance using customary law and even taking into account the economic ability of the heirs. This problem raises debate in the division of inheritance. The problems in this research include what are the reasons for the Pringsewu community in dividing the inheritance using the economic abilities of the heirs? and what are the views of Nahdatul Ulama and Muhammadiyah figures regarding the phenomenon of the Pringsewu community in the distribution of inheritance using the economic abilities of the heirs? The research method used was a field study method by conducting surveys and interviews with Nahdatul Ulama and Muhammadiyah clerics. The findings of this study are heirs using economic ability as a consideration for dividing inheritance because heirs see the different economic abilities of heirs. The view of Nahdatul Ulama figures allows this because it refers to the principles of inheritance, one of which is the principle of balanced justice. According to Muhammadiyah figures, it is not allowed because in the distribution of inheritance, the furudul muqaddah cannot be changed, namely the parts that have been determined in the Qur'an
